Background information
The data above includes trade union time, cost and input for north Yorkshire schools other than for a small number of academies which have their own arrangements .This is because schools access Trade Union time and input from the County Council as part of the service they purchase from Human Resources. This means that the cost of the Trade Union support for schools is included in the above figures which cover a workforce inclusive of schools staff of some 19,000. The vast majority of teaching union time and cost relates to schools as does at least half of Unison time and costs.
North Yorkshire County Council’s facilities agreement (legally all employers with union membership in their workforce have to have one of these) covers time off for trade union duties, attending trade union meetings, training, physical facilities and time off for trade union activities. Only certain meetings and attendance at national/local union conferences attract paid time off.
There is a legal requirement on all employers to involve union representatives in the following duties which aren’t internal union activities but instead are part of the structure and arrangements for complying with employment law in how staff are managed: · Representing individual staff in relation to redundancy /disciplinary/ capability/ grievance procedures · Representing individuals and groups of staff in relation to workplace changes including restructurings, changes in working practices/process, role/skill changes etc., most of which will result in contractual changes. · Participating in consultation and negotiation arrangements on local terms and conditions. · Consultation on/involvement/input into service changes which will impact on staff.
All employers in both public and private sector are equally required to involve trade unions in all these activities. Their input and individual/group rights to union representation are enshrined in statute and not optional.
To provide some context to this information, North Yorkshire County Council has some 19,000 staff of which 5596 are teachers and continues to restructure and change its services at an unprecedented level in response to government austerity measures and resulting budget reductions. To illustrate, since 2010 a third of County Council staff (non-teaching) have been declared at risk of redundancy and been subject to a restructure. A proportion of staff have been through this process 2 and 3 times in over 200 staff restructures. This will continue for the foreseeable future and trade union input is a legal requirement for each change and individual affected.
